DarkHeart Terms & Conditions

Welcome to DarkHeart's Terms and Conditions of Use (these "Terms"). This is a contract between you and DarkHeart LLC and we want you to know yours and our rights before you use the DarkHeart mobile application ("DarkHeart" or the "App"). Please take a few moments to read these Terms before enjoying the App, because once you access, view or use the App, you are going to be legally bound by these Terms. Please also read our Privacy Policy, which forms part of these Terms.

Please be aware that if you subscribe to services for a term (the "Initial Term"), then the terms of your subscription will be automatically renewed for additional periods of the same duration as the Initial Term at DarkHeart's then-current fee for such services, unless you cancel your subscription in accordance with Section 11 below.

Subscription and Refund Information: You may cancel your subscription at any time through your device's subscription settings. If you subscribed using your Apple ID, refunds are handled by Apple, not DarkHeart. If you wish to request a refund, please visit Apple Support. If you subscribed using your Google Play Store account or through DarkHeart, please contact customer support.

1. DARKHEART RULES

Before you can use the App, you will need to register for an account ("Account"). In order to create an Account you must:

be at least 18 years old or the age of majority to legally enter into a contract under the laws of your home country if that happens to be greater than 18; and
be legally permitted to use the App by the laws of your home country.

Please note that we monitor for underage use and we will terminate, suspend or ask you to verify your Account if we have reason to believe that you may be underage.

You can create an Account via manual registration, or by using your Apple ID or Google account login details. If you create an Account using third-party login details, you authorize us to access, display and use certain information from your account. For more information about what information we use and how we use it, please check out our Privacy Policy.

Unfortunately, we cannot allow you to use another person's DarkHeart account or to share your DarkHeart account with any other person without permission. You are responsible for ensuring that any use of your account complies with these Terms.

You can delete your Account at any time by going to the "Settings" page when you are logged in and clicking on the "Delete account" link. Your Account will be deleted immediately but it may take a little while for Your Content (defined below) to be completely removed from the App. Your profile information will be treated in accordance with our Privacy Policy.

2. PROHIBITED USERS

DarkHeart is committed to maintaining a safe and lawful community. You are not permitted to create or maintain an Account if you:

Have been convicted of, or are a registered sex offender for, any sex crime, or any crime involving violence;
Have been convicted of a felony or indictable offense (or crime of similar severity), unless you have received clemency for a non-violent crime;
Are prohibited from using the Service by any court order or are subject to any restraining order or injunction;
Are required to register as a sex offender in any jurisdiction.

By creating an Account, you represent and warrant that you have never been convicted of a felony or indictable offense (or crime of similar severity), that you are not required to register as a sex offender with any government entity, and that you are not prohibited by law from using our Service.

If we learn that you have misrepresented your criminal history or that you are prohibited from using DarkHeart, we will immediately terminate your Account, remove all of your data from our platform, and may report such activity to appropriate law enforcement authorities.

3. CONTENT

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, trademarks, or any other rights of any third party.

There are three types of content that you will be able to access on the App:

content that you upload and provide ("Your Content");
content that members provide ("Member Content"); and
content that DarkHeart LLC provides (including, without limitation, database(s) and/or software) ("Our Content").

Confession Wall Content

The Confession Wall feature allows users to post anonymous confessions. While confessions are anonymous, all content posted to the Confession Wall must comply with our community guidelines and legal requirements. Confessions should be personal reflections, thoughts, or experiences that do not harm others or violate any laws. We reserve the right to remove any confession that violates these terms or our community standards.

Guidelines for Confession Wall Posts:

Share personal experiences, thoughts, or feelings that are meaningful to you
Respect the privacy and dignity of others - avoid naming specific individuals
Focus on self-reflection and personal growth rather than judgment of others
Keep content appropriate for a diverse community of adults
Avoid graphic descriptions of violence, self-harm, or illegal activities
Do not use the platform to threaten, harass, or intimidate others
Refrain from posting content that could identify or harm vulnerable individuals
Remember that while posts are anonymous, they are still subject to legal review

We actively monitor Confession Wall content and may remove posts that violate these guidelines. Repeated violations may result in account suspension or termination. If you see content that concerns you, please report it through our in-app reporting feature.

4. PROHIBITED CONTENT

Prohibited conduct

In addition to the restrictions on Content below, you agree not to use the Service to stalk, abuse, harass, threaten, defraud, or harm other users; to coordinate or encourage illegal activity; or to arrange, pressure, or facilitate interactions intended to cause harm or to evade our safety tools. Prohibited conduct includes using DarkHeart to plan or carry out harmful or unlawful behavior toward others, whether that behavior occurs on or off the platform. We may take action on your Account for such conduct consistent with these Terms, including Section 5 (Account Termination) and Section 7 (Off-Platform Conduct).

You agree not to use the Service to post, transmit, or otherwise make available any Content that is:

Unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, obscene or profane.
Contains explicit or graphic descriptions or accounts of sexual acts.
Contains inappropriate or explicit images, including but not limited to nudity or graphic violence.
Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
Constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party.
is illegal or encourages, promotes or incites any illegal activity;
is harmful to minors;
is defamatory or libelous;
infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights);
shows another person which was created or distributed without that person's consent;
contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person;
is sexually explicit or pornographic;
promotes violence, discrimination or illegal activities;
is spam, junk mail, or unauthorized advertising;
contains viruses, malware, or other harmful code.

We reserve the right to terminate or suspend your account and block access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

5. ACCOUNT TERMINATION

We reserve the right at our sole discretion to terminate or suspend any Account, restrict access to the App, or make use of any operational, technological, legal or other means available to enforce the Terms. We may take such action, at any time without liability and without the need to give you prior notice.

Subscriptions and Purchases Upon Account Termination

If you have purchased a subscription or made in-app purchases through DarkHeart, and your account is terminated or disabled due to violation of these Terms and Conditions, Community Guidelines, or any other policies, your account will be immediately disabled. In such cases, you may request a refund for any active subscriptions or recent purchases. Please visit our refunds page for more information on how to request a refund and our refund policy. Note that refund eligibility and processing are subject to the policies of your payment provider (Apple App Store, Google Play Store, or DarkHeart directly).

6. SAFETY MEASURES

Safety is a top priority at DarkHeart. We use a combination of human moderators and automated systems to monitor and review DarkHeart accounts and interactions for content that may be against our Community Guidelines, against our Terms and Conditions, or otherwise harmful.

Our members play a critical role in the safety of DarkHeart by reporting content or behavior that may violate our Community Guidelines. If anything happens that makes you feel uncomfortable or unsafe, we highly encourage you to unmatch with or block and report the member.

Reporting misconduct

You may use our in-app reporting feature (and the channels described in Section 8) to report violations of these Terms, safety concerns, or misconduct by other users. Reports may include behavior that began on DarkHeart and continued outside the platform, or other conduct you believe is relevant to whether someone should remain on the Service. We review reports in our discretion; we are not obligated to investigate, disclose the outcome of a report, or take any particular action. Any action we take is without admission of liability and is further described in Section 7 (Off-Platform Conduct) and Section 14 (Limitation of Liability).

Image Moderation System

DarkHeart uses advanced AI-powered image moderation to automatically filter profile photos for inappropriate content, ensuring a safe dating environment. Our system analyzes every uploaded image using multiple AI models to detect and prevent harmful content.

What We Check:

Nudity Detection: Sexual content, suggestive poses, and inappropriate imagery
Face Detection: Ensures real human faces are present, rejecting AI art, objects, or landscapes
Age Verification: Detects minors (under 18) with 80% confidence threshold - automatic rejection for child content
Image Quality: Minimum quality score of 0.3 to reject blurry, low-resolution images
Content Type: Prefers real photos over AI-generated content, rejecting illustrations and drawings
Safety Filters: Violence and gore detection to prevent harmful content

Rejection Criteria: Images are automatically rejected if they contain:

No human faces detected
Minors (under 18)
Nudity or sexual content
Violence or gore
AI-generated images
Poor quality (blurry, low-resolution)
Illustrations or drawings

Our image moderation system prioritizes user safety while maintaining efficient processing for a smooth user experience. All profile photos are automatically screened before being approved for display.

7. OFF-PLATFORM CONDUCT

Our service facilitates user connections but does not govern or control interactions that occur outside of the platform.

We are not responsible for any communications, transactions, or conduct between users that take place outside of the platform, even if such interactions originated through our service.

Users acknowledge and agree that they engage with others at their own risk. We do not verify user identities, backgrounds, or intentions beyond the tools explicitly provided within the platform.

We reserve the right, but have no obligation, to review and take action on user accounts based on reports of misconduct, including behavior that may have originated on the platform but continued elsewhere.

To the fullest extent permitted by law, we disclaim all liability for any direct or indirect loss, damage, harm, or claims arising from user interactions occurring outside of the platform.

This Section works together with Section 4 (including Prohibited conduct), Section 6 (Reporting misconduct), Section 13 (Disclaimer), and Section 14 (Limitation of Liability).

8. CHILD SAFETY & PROTECTION

DarkHeart is committed to protecting minors and maintaining a safe, adult-only environment through advanced verification and monitoring systems. Child safety is our highest priority.

Zero Tolerance Policy

We have zero tolerance for any content or behavior involving minors, including:

Child Sexual Abuse and Exploitation (CSAE)
Grooming behavior targeting minors
Sharing or soliciting images of minors
Any content involving children under 18

Advanced Content Monitoring

Multi-layered content moderation using AI and human review to detect inappropriate content. This includes AI-powered image analysis, text content filtering, and real-time monitoring with human review escalation.

Dedicated Reporting System

In-app reporting system for immediate escalation of safety concerns. Features include one-click safety reporting, 24-hour response time, law enforcement coordination, and NCMEC reporting integration.

Compliance & Legal Protection

DarkHeart exceeds Google Play safety standards with published safety protocols, in-app reporting mechanisms, and CSAM response protocols. We maintain full compliance with child safety laws, law enforcement cooperation, document retention policies, and liability protection measures.

Violations & Consequences

Any violations result in immediate account termination, content removal, and platform ban. We maintain law enforcement notification protocols, NCMEC reporting, local authorities notification, evidence preservation, and legal documentation.

Report Safety Concerns

Report safety concerns through our in-app reporting feature, email safety@darkheart.app, or directly to NCMEC at report.cybertip.org.

DarkHeart is committed to creating the safest possible dating environment for adults. Our comprehensive safety measures ensure that only verified adults can access the platform, while our advanced monitoring systems protect against any attempts to harm minors.

9. PRIVACY

For information about how DarkHeart LLC collects, uses, and shares your personal data, please check out our Privacy Policy. By using DarkHeart, you acknowledge that we may use such data in accordance with our Privacy Policy.

10. MARKETING COMMUNICATIONS

By creating an Account, you consent to receive marketing emails, promotional materials, and other communications from DarkHeart LLC at the email address you provide during registration. You may opt out of these communications at any time by clicking the unsubscribe link in any marketing email or by contacting us at support@darkheartapp.com. Please note that you may still receive important account-related communications even if you opt out of marketing emails.

11. SUBSCRIPTION SERVICES

DarkHeart offers premium subscription services. By subscribing, you agree to pay the applicable fees and authorize automatic renewal of your subscription. You may cancel your subscription at any time through your device's subscription settings.

12. INTELLECTUAL PROPERTY

The App and its original content, features, and functionality are and will remain the exclusive property of DarkHeart LLC and its licensors. The App is protected by copyright, trademark, and other laws.

13. DISCLAIMER

The DarkHeart app and all its content are provided to you "as is" and "as available" without any warranties, either express or implied. We do not guarantee that you will find compatible matches or that the app will meet your specific expectations.

We do not make any warranties that the app will be uninterrupted, secure, or error-free. Your use of the app is at your own risk. You are solely responsible for your interactions with other users. DarkHeart LLC is not responsible for the conduct of any user and does not conduct background checks on its members.

Section 7 (Off-Platform Conduct) and Section 14 (Limitation of Liability) apply to meetings, communications, and disputes between users that occur outside the platform.

14. LIMITATION OF LIABILITY

DarkHeart LLC will not be liable for any damages arising from your use of the app, including but not limited to direct, indirect, incidental, consequential, or punitive damages. This includes loss of data, income, or goodwill.

Without limiting the foregoing, to the fullest extent permitted by law, DarkHeart LLC is not liable for any loss, damage, harm, claims, or disputes arising from communications, meetings, transactions, or any other interactions between users that occur off the platform (including any conduct that began on the platform and continued elsewhere), even if reported to us. Your sole remedy for dissatisfaction with the app or with other users is to stop using the Service and to cease contact; some states do not allow the exclusion of certain damages, so these provisions may not apply to you.

15. INDEMNITY

You are responsible for all actions you take and information you post on DarkHeart. You agree to defend and hold DarkHeart LLC harmless from any claims arising from your use of the app, including:

your use of the app;
content you upload or submit;
any breach of these Terms;
violation of any laws or third-party rights.

We have the right to settle any claims brought against us. You agree to cooperate with us in defending any relevant claims.

16. LIABILITY

We are not liable for your misuse of the Service. You agree to indemnify and hold DarkHeartLLC harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service.

17. GOVERNING LAW

These Terms shall be interpreted and governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
